Overview.

The Senior Compliance & Governance Analyst is primarily responsible for actively supporting the Compliance Manager in designing, implementing, maintaining and operating an effective Compliance Management System (CMS) and Corporate Governance Framework in accordance with all relevant internal and external compliance and corporate governance requirements.

 

Key Responsibilities:

  • Supports the Compliance Manager in the operation of the local Compliance Management System covering these ten Compliance Instruments:
  • Definition and regular update on compliance strategy.
  • Management of monitoring of relevant legal requirements for compliance.
  • Regular compliance risk assessments, including privacy impact assessments, AML, Consumer Protection and Data Privacy Protection requirements analyses.
  • Management of internal rules and regulations.
  • Regular compliance communication towards employees.
  • Regular compliance trainings and business coaching.
  • Implementation of compliance processes and tools.
  • Compliance case management (e.g., inquiries by employees, customers and authorities, complaints and incidents) including management of compliance measures.
  • Regular and ad-hoc compliance reporting to local management, central compliance functions, and where applicable, to supervisory authorities.
  • Compliance spot checks, including audits, to ensure effectiveness of internal compliance instruments and measures.
  • Applies these compliance instruments to the following Compliance Subjects in order to identify and mitigate potential compliance risks: Anti-Fraud Management Anti-Money Laundering, Antitrust Prevention, Corruption Prevention, Data Privacy Protection, Information Protection, Internal Regulations, Human Rights, Export Controls and further local compliance subjects.
  • Monitor, assess and enhance AML/ATF to align with federal regulations (eg. FINTRACT, PCMLTFA)
  • Accountable for assisting with the day to day related activities that supports the organization’s efforts to comply with all applicable AML legislation.
  • Performs Know Your Customer (KYC) and Enhanced Due Diligence (EDD) on high risk individuals, analyzing data for suspicious patterns, conduct investigations, creating and filing Suspicious Transaction Reports (STRs) and relevant reports as required by law to FINTRAC.
  • Supports the Compliance Manager with the National Regulatory & Compliance Committee meetings and advises Associates and management in compliance matters.
  • Updates and implements policies and procedures relating to the governance of the Compliance management system and compliance with federal and provincial laws/regulations.
  • Track regulatory changes and advice on impacts to business operations
  • Prepare and execute applicable training and awareness sessions for Associates on various compliance related topics

 

Support the operation of the Corporate Governance Framework:

  • Policies & Procedures – Ensure relevant Policies and Procedures are established and kept up to date in compliance with local regulations and central minimum requirements.
  • Perform self assessment and proactively follow up with business units to ensure policies and procedures are reviewed and updated in a timely manner.
  • Regulation Landscape – Build and maintain a complete program/policy/procedure landscape applicable for BMW Group Financial Services Canada.
  • Committee Management – Maintain oversight over all committees and ensure clean scope of the committees’ decision making competence.
  • Training & Communication – Design and deliver topic specific training, and ensure Corporate Governance topics are communicated in a timely manner.
  • Advisory – Advise and support business units on relevant corporate governance topics.
  • Intranet Governance – Periodic review of intranet pages to ensure they are accurate and relevant.
  • Monitoring and Testing – Periodic testing to ensure adherence to Corporate Governance requirements.
  • Reporting – Periodic reporting to the NRCC on relevant corporate governance topics.

 

Education:

  • Post secondary degree in related field of study
  • Relevant compliance related certification(s)  such as CAMS, CIPM, CIPP/C

 

Additional Skills:

  • 3-5 years of relevant, professional experience, preferably in the Financial sector
  • Excellent understanding and working knowledge of regulatory requirements including Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA), federal / provincial privacy legislation, and consumer protection legislation.
  • Excellent communication (written, oral & presentation), critical thinking, relationship management and project management skills.
  • Advanced Microsoft Office skills.
  • Strong written skills with the ability to draft policies and training materials
  • Strong interpersonal and organizational skills
  • Self-directed / self-starter (i.e. entrepreneurial, proactively identifies necessary and/or value added tasks; appropriately self-identifies areas in which to engage.
  • Self-motivated, results-driven and strong attention to detail
  • Ability to work in a fast-paced environment and respond well under pressure and tight deadlines.
  • Automotive industry experience would be an asset.
